For this to happen, there needs to be trust between all parties, and this is where we believe it is important that you trust us and know how we will treat your data and protect your right to privacy.

1. Applicable to the informative use of the website

When you visit our site for informational purposes without creating a booker or helper profile, the following categories of personal data are collected, stored and processed:

(a) "Log Data": When you visit our web pages, a so-called log data record (so-called server log files) is stored temporarily and anonymously on our web server. This consists of:

  • the page from which the page was requested (so-called referrer URL)

  • the name and URL of the requested page

  • the date and time of the request

  • the description of the type, language and version of the web browser used

  • the IP address of the requesting computer, which is shortened so that a personal reference can no longer be established

  • the amount of data transferred

  • the operating system

  • the message whether the request was successful (access status/http status code)

  • the GMT time zone difference

(b) "Contact form data": When contact forms are used, the data transmitted as a result are processed (e.g. gender, surname and first name, address, company, e-mail address and the time of transmission).

(c) Newsletter: In addition to the purely informational use of our website, we offer the subscription to our newsletter, with which we inform you about current developments and news at Happy Helper. If you subscribe to our newsletter, the following "newsletter data" will be collected, stored and processed by us:

  1. the page from which the page was requested (so-called referrer URL)

  2. the date and time of the request

  3. the description of the type of web browser used

  4. the IP address of the requesting computer, which is shortened in such a way that a personal reference can no longer be established

  5. the e-mail address

  6. the date and time of registration and confirmation.

We would like to point out that we evaluate your user behavior when sending the newsletter. For this evaluation, the e-mails sent contain so-called web beacons or tracking pixels, which are single-pixel image files stored on our website. For the evaluations, we link the aforementioned data and the web beacons with your e-mail address and an individual ID. Links contained in the newsletter also contain this ID. The data is collected exclusively pseudonymously, i.e. the IDs are not linked with your other personal data, a direct personal reference is excluded.

If you no longer wish to subscribe to the newsletter, you can use the unsubscribe link provided in each newsletter or declare your cancellation by sending an e-mail to support@happyhelper.de or by sending a message to the contact details provided above.

(d) Where we receive your data from

We receive the data from (a) automatically when you visit the site.

We only receive the data from (b) and (c) when you use the corresponding input forms on our website.

(e) Purpose and legal basis

The purposes for processing the data from (a) is the optimization of the website presentation as well as the detection of abusive access to the website.

The purposes for processing the data from (b) and (c) are to enable the best possible support for the visitors of the website as well as the possibility to keep the visitors up to date with interesting newsletter content.

The legal basis for processing the data from (a) is

  • the legitimate interest according to Art. 6 para. 1 lit. f DSGVO.

The legal basis for processing the data from (b) and (c) is

  • the consent given to us according to Art. 6 para. 1 lit.a DSGVO

  • as well as our legitimate interest in analyzing your user behavior and thereby optimizing the newsletter according to Art. 6 para. 1 lit. f DSGVO.

We collect and process personal data about you to enable contact and transactions between you, Helpers and Happy Helper.

We process the following information about you:

  • Geolocation for addresses entered

  • Information about the use of the website

  • Log data, information about devices used and IP address

  • Cookies

  • Date and time of the start and completion of the booking

  • Information about transactions, such as payment method used, date, time and amount of payment, including payment amount for cleaning and commission and fee to Happy Helper

  • Information about booked helpers

  • Reviews of Helpers

  • Contact information: First name, last name, address, email address, phone number.

  • Number of square meters to be cleaned

  • Booking frequency

  • Payment method

  • Partner membership number

  • Permission to receive marketing

  • Separate billing address

  • Ratings from Helper

(b) Where we get your information

We collect the information in items 1-4 automatically when you visit the Platform.

You share the information in items 5-12 with us when you make a booking on the Platform.

You may choose to share the information in paragraphs 13-16 with us when you use the Platform to make bookings.

(c) Purpose and legal basis for processing your personal data.

The purposes for processing the data in (a) is to provide our services for arranging household-related services. We need the data to be able to create Booker profiles so that we can connect Bookers and Helpers.

The legal basis for our processing of the data in points 1-17 results from:

  • Article 6 (1) lit. a to b DSGVO.

  • Article 7 para. 1-4 DSGVO

(e) Sharing of information from Booker to Helper.

To facilitate bookings and other interactions between users of the Platform, we will share information between user profiles. When a Booker requests a Helper for a booking, information about the Booker such as profile, name, address, email address, phone number, ratings and reviews of Helpers, requested time and date of cleaning, number of square feet to be cleaned, and hourly rate for the given booking will be shared.

(f) Retention of personal data

We retain your personal data for different periods of time. Depending on the circumstances, we retain your personal data until the purpose or legal basis for the retention no longer applies.

However, storage may be necessary beyond the specified time in the event of a (threatened) legal dispute with you or for reasons of tax law or commercial law. If the storage period prescribed by legal regulations expires, the personal data will be blocked or deleted, unless further storage by us is necessary and there is a legal basis for this.

However, you can contact us at any time and request deletion of your booker account. To do so, use the contact options provided at the very top under Person Responsible.

3. APPLICABLE TO HELPERPROFILE

(a) Processing of personal data

We collect and process personal data about you to enable contact and transactions between you, Booker and Happy Helper.

We process the following information about you:

  • Geolocation for addresses entered

  • Information about the use of the website

  • Log data, information about devices used and IP number

  • Cookies

  • Information about transactions, such as amounts charged for bookings, including deposit amounts, insurance and platform fees

  • Information about agreements made with Booker, such as date, time, Booker's address and name, and other related information

  • Reviews of Booker

  • Contact information: First name, last name, address, email address, phone number.

  • Evidence identifying the helper (such as personal master data)

  • Bank account

  • Hourly rate

  • Work areas

  • Availability for bookings in the calendar

  • Date of termination of the use of the platform as a Helper

  • Profile picture

  • Profile text

Answers to the questions about being at least 18 years old, having a German social security number, having a German bank account, having a German work and residence permit, and having a clean criminal record

Answers to the questions about cleaning and using the platform, regarding creating the profile

  • Membership number of partners

  • Permission to receive advertising

(b) Where we get your information

We collect the information in items 1-4 automatically when you visit the Platform.

You share the information in Sections 5-17 with us when you create a Helper Profile on the Platform.

You may choose to share the information in paragraphs 18-20 with us when you have a Helper Profile on the Platform.

(c) Purpose and legal basis for processing your personal data.

The purposes for processing the data in (a) is to provide our services for brokering household-related services. We need the data to be able to create Booker profiles so that we can connect Bookers and Helpers.

The legal basis for our processing of the information in points 1-10 and 11-21 arises from:

  • Article 6 (1) lit. a, b DSGVO

  • Article 7 para. 1-4 DSGVO

(d) Disclosure of personal data

We may, where appropriate, share the information that you have agreed to share.

In order for Bookers to request bookings from Helpers, Helper profiles are publicly displayed on the Platform. Information such as name, experience, ratings and reviews, hourly rate, desired work areas, and calendar availability are shared here.

(g) Sharing of information from the Helper to the Booker.

To facilitate bookings and other interactions between users of the Platform, we will share information between user profiles. When a Helper accepts a booking request from a Booker, information about the Helper such as profile, name, email address, phone number, experience, ratings and reviews, hourly rate, desired work areas, and calendar availability will be shared.

(h) Retention of Personal Data.

We retain your Personal Data for varying periods of time. Depending on the circumstances, we retain your personal data until the purpose or legal basis for retention no longer applies.

However, storage may be necessary beyond the specified time in the event of a (threatened) legal dispute with you or for reasons of tax law or commercial law. If the storage period prescribed by legal regulations expires, the personal data will be blocked or deleted, unless further storage by us is necessary and there is a legal basis for this.

4. data processing for order processing

When you buy products from us in our Happy Shop, there are two different processes in which personal data is collected and processed by us.

(a) Order processing

To fulfill our contractual obligations to our bookers, we work with external shipping partners. We pass on your name as well as your delivery address to a contractual partner selected by us exclusively for the purpose of delivering the goods in accordance with Art. 6 Para. 1 lit. b DSGVO.

In addition, the respective data protection provisions of the respective payment service provider used shall apply.

5. YOUR RIGHTS

You have a number of rights under the GDPR in relation to our processing of information about you.

You have the right to see the data we process about you and a range of additional information.

In exceptional circumstances, you have the right to have information about you deleted before the date of general deletion occurs.

Right to restriction of processing

In certain cases, you have the right to restrict the processing of your personal data. If you have the right to restrict processing, we may process the data in the future - apart from storage - only with your consent or for the establishment, exercise or defense of legal claims or for the protection of a person or important public interests.

Right to object

In certain cases, you have the right to object to or prohibit the processing of your personal data by us.

You may also object to the processing of your data for direct marketing purposes:

6. cookies

We use cookies on our websites. Cookies are small text files that are assigned and stored on the browser you are using by a characteristic string of characters, and through which certain information flows to the body that sets the cookie. Cookies cannot execute programs or transfer viruses to your computer and therefore cannot cause any damage. 7. tools

(a) Google Analytics: On this website we use the analysis tool Google Analytics, provided that you have given your consent to its use. This is a tool of the company Google Ireland Ltd. Gordon House, Borrow street, Dublin 4, Ireland for visitors from the EU, a subsidiary of Google LLC with headquarters at 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. This is a web analytics service to analyze the use of this website. For this purpose, Google uses cookies that are stored on your device and thus enable the analysis of your user behavior. The information thus generated is usually transferred to Google servers in the USA and also stored there. Since we have activated IP address anonymization, your IP address is usually shortened within the European Union before being sent to Google's servers in the USA. Only in exceptional cases will the full IP address be transferred to Google's servers in the USA and only there will it be shortened. (b) Support Software: In order to provide our bookers with optimized services, we use on our website the support software of Intercom R&D Unlimited Company from the USA, located at 1019 Market Street San Francisco, CA 94103. The support software enables us to offer our bookers a support service that can provide quick and uncomplicated help in case of any questions. If you use the support contact, the following data will be collected, stored and used by us:

  • the given name

  • the IP address

  • the information transmitted by you

  • the email address

With your consent, this data will also be transferred to Intercom R&D Unlimited Company on servers in the USA. In this context, USA is a third country in the sense of the DSGVO and there is no adequacy decision according to Art. 45 DSGVO for the data transfer. In the USA, authorities have the right to access data at companies under certain conditions and this is not compatible with the GDPR. However, there are suitable guarantees within the meaning of Art. 46 (2) (d) DSGVO, because we have concluded a contract processing agreement with Intercom R&D Unlimited Company, for the protection of your data in accordance with Art. 28 (3) DSGVO. In this contract, Intercom R&D Unlimited Company has subjected itself to the EU standard contractual clauses and thus ensures that your data is processed in accordance with Art. DSGVO are processed.

(c) Email Software: We use the service of Autopilot HQ Inc, located at 1390 Market Street Suite 200, San Francisco CA 94102, USA. By using it, your personal data is also stored on the servers of Autopilot HQ Inc, in the USA. In this context, USA is a third country within the meaning of the GDPR and there is no adequacy decision according to Art. 45 GDPR for the data transfer. In the USA, authorities have the right to access data at companies under certain conditions and this is not compatible with the GDPR. However, suitable safeguards exist within the meaning of Art. 46(2)(d) DSGVO, because we have concluded a contract processing agreement with Autopilot HQ Inc, for the protection of your data in accordance with Art. 28(3) DSGVO. In this contract, Autopilot HQ Inc. has subjected itself to the EU standard contractual clauses and thus ensures that your data is processed in accordance with iSd. DSGVO are processed.

(d) Cloud Computing: we use the cloud computing service of Digital Ocean LLC, a company located at 101 Avenue of the Americas 10th Floor New York, NY 10013 United States. We use the service to have digital servers available to make our work more efficient and flexible. The server location is in a data center in Frankfurt, Germany, which is ISO/IEC 27001:2013 certified, among other things. No data is transferred to Digital Ocean LLC's servers in the USA.

We have concluded an order processing agreement with Digital Ocean LLC.

(e) Chat Software: We use the chat software of Slack Technologies Inc, located at 45 Fermont Street, 32nd Floor, San Francisco, 94105, USA. We use Slack Technologies Inc. software to provide a simple means of contact through a chat system on our website.

When you use the chat software, this data is also transmitted to servers of Slack Technologies Inc. in the USA. In this context, USA is a third country in the sense of the GDPR and there is no adequacy decision according to Art. 45 GDPR for the data transfer. In the USA, authorities have the right to access data at companies under certain conditions and this is not compatible with the GDPR. However, there are suitable guarantees within the meaning of Art. 46 para.2 lit. d DSGVO, because we have concluded a contract processing agreement with Slack Technologies Inc. for the protection of your data in accordance with Art. 28 para. 3 DSGVO. In this contract, Slack Technologies Inc. has subjected itself to the EU standard contractual clauses and thus ensures that your data is processed in accordance with Art. 46 Para. DSGVO are processed.

(f) Payment providers: When you register as a Helper or use a Service as a Booker, you are using the service of the payment provider Mangopay S.A., located at 2 Avenue Amélie, L-1125 Luxembourg.
